  1. Introduction and abbreviations
    The sale of products offered on the www.maidamila.com website is governed by the following terms.
  2. Terms validity and website users
    The products offered on the Website are for sale exclusively to natural persons of legal age that purchase items for their own private use, unrelated to any potential commercial or professional activity. Resale, rental or transfer of products purchased on the Website is expressly prohibited for any commercial or professional purpose. maidamila can make any changes or additions to these Terms of Sale at any time. In any event, the customer shall be bound by the version of the terms of sale in force at the time of the purchase. The customer, by sending a purchase order, acknowledges to have carefully examined these sales terms and conditions. The customer shall however still receive a confirmation email for the order at the address indicated.
  3. Purchase procedures
    Each product selected by the customer of the Website can be displayed in a dedicated web page that contains its description, photos and highlights the unit price (including VAT), available colors and sizes or measurements. Each sale conducted by maidamila through its website may concern one or more products, without prejudice to any availability issues indicated in the following paragraphs. By choosing the articles he’s interested in, the customer places them on his cart. The same cart displays a short, summarized description of the selected products. Before confirming the order, the customer shall carefully check the contents of the cart by filling out the on-line purchase form and accepting these terms of sale. The purchase procedure is complete after selecting the “Complete Order” option in the order summary page. At such time, upon supplying data that identifies the buyer, the order is directly sent to maidamila to be processed and cannot be modified or deleted, except for what is foreseen by the right of cancellation. Such confirmation of order constitutes proof of acceptance of the dispositions in these terms of sale. The images and pictures on the Website might depict items on sale slightly differently, including their dimensions and proportions, due also to the resolution quality of the screen or device that the customer uses. The customer shall then have to reference the technical specifications (for instance, model size, components, and so on). maidamila does not ensure the exact correspondence of the graphic representations of the products on the website.
    Maidamila reserves the right to reject purchase orders from any customer that maidamila might deem unable to fulfill obligations, due for instance to an existing violation of the contractual provisions for the on-line purchase via the Website.
  4. Availability
    The customer acknowledges that stocks of products offered by maidamila through its website are limited. The Website displays products that are considered available for purchase by the customers. Occasionally there may be issues regarding the availability of some of the products. The customer will be informed via email of such occurrences as soon as possible (and in any case within the delivery terms hereunder specified). The customer will be offered the chance to order a different item or to cancel the order in whole or in part. Should the customer choose the cancel the entire order, his credit card won’t be charged. maidamila reserves the right to change or update products offered on the website or their specifications, at any time, without prior notice.
  5. Price and payment methods
    All prices of products offered on the website include VAT. Prices of products for sale are indicated in Euros. The total amount charged to the customer will be highlighted in the cart and in the order details page, displayed once the whole procedure is complete. maidamila reserves the right to modify prices of products offered on the website at any time without prior notice. The customer will be charged the prices on the website at order date, except as required by art. 4 should products be unavailable.
    maidamila accepts payments via the following

    • Payment via Paypal

    Products are shipped only once payment has gone through.
  6. Products delivery restrictions
    Products shall be sent to the address indicated by the customer in the on-line purchase form. Once the products are shipped, a message detailing the shipping company and tracking number shall be sent to the customer’s email. A note shall be left should the customer be absent upon delivery of the products at the indicated address, following which the customer shall have to contact the carrier as soon as possible to agree on further delivery terms. maidamila shall not ship to any PO Box nor will accept orders with unidentifiable customer, recipient of the products or delivery address.
  7. Delivery methods
    maidamila shall make every effort to deliver products to the customer as soon as possible. Once the purchased products have been shipped, maidamila shall send an email to the customer at the address indicated in the online form of the purchase order, indicating the shipping company and tracking number in order to monitor the shipment. Customers may contact maidamila at the info@maidamila.com  email address should any issue with the shipment arise or should items still be undelivered 5 working days after the delivery date indicated in the order confirmation email.
  8. Withdrawal
    Right of withdrawal: Customers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the customer or its nominee acquires physical possession of the product. In order to exercise his withdrawal rights, the customer must explicitly inform us of his decision to withdraw (for instance with a letter sent by post or an email at info@maidamila.com ). The customer can also fill out and send the standard withdrawal form available for download at LINK (inserire pdf e call to action)or any other explicit declaration via email. Should this option be chosen, we’ll confirm the reception of the withdrawal via email without delay. To abide by the withdrawal rights just send the aforementioned communication on your withdrawal before the end of the withdrawal period.
    Withdrawal effects: All payments to us shall be reimbursed if you withdraw from this agreement, except for return shipment costs for the withdrawal (including any additional costs due to the customer choosing a type of delivery different from the standard, low-priced delivery we offer), without undue delay and in any case no later than 14 days from the day we’re informed of the customer’s decision to withdraw. Such reimbursements shall be done via bank transfer to the account indicated by the customer; in any case, the customer shall not be charged for any cost arising from such reimbursement. maidamila reserves the right to withhold reimbursement until the products subject of the withdrawal are received back. The customer shall bear the costs for returning the products subject to withdrawal, which will have to be sent back within 14 days from the day the customer informs us of his intention to withdraw from the purchase. maidamila is available to estimate a cost. maidamila cannot be held liable for any loss of products, shipment to incorrect address or delivery delays, on the understanding that the customer assumes all risks and costs deriving from such delivery. The customer is solely responsible for any diminished value of the goods only where that results from handling of the goods in any way other than what is necessary to determine their nature, features and functioning. maidamila shall assess if the returned products are actually in their original conditions. Should the products returned by the customer be damaged, incomplete, deteriorated and/or dirty, maidamila shall immediately inform the customer but it is understood that maidamila will not reimburse them. In this case the customer shall contact maidamila to agree on terms for returning the products to the customer. The seller still has the right to ask for a reimbursement for any damage or non-correspondence of the returned products that were delivered to the customer. In compliance with what is foreseen by section 59, art. c) of the Consumer Code, the Consumer shall not be able to exercise his withdrawal rights for the supply of goods made to the consumer’s specifications or clearly personalized.
  9. Any difference between order and delivered product
    Once the order has been delivered, the consumer shall check right away if the products correspond to the articles that have been ordered. Any anomaly detected on delivery (for instance, any tampering or damage to the package) or the contents of the package (products different from those ordered, missing items, and so on) must be promptly communicated, when possible, on the delivery document by way of reservation signed by the customer. The customer himself shall in any case contact maidamila to point out the discrepancy within five working days upon receipt of the package. Should a discrepancy between ordered products and delivered products be established, the customer has the right to request fulfillment of the order, subject to the return of what was received and except in the case of unavailability of the ordered products. maidamila shall always have the option to offer the shipment of different products of the same type, or alternatively to reimburse, when possible, any potential price difference.
  10. Warranties
    All products sold to the consumer by maidamila are under warranty for 24 months for any flaws of conformity, pursuant to Legislative Decree 206/05. The seller is responsible towards the customer for any lack of conformity upon delivery. In case of lack of conformity, the consumer is entitled to the restoration, at no charge, of the conformity of the product by repair or replacement (the customer may ask the seller, at its choice, to repair the product or substitute it at no cost in both cases, except if the required restoration is objectively impossible or excessively expensive compared to the other option) that is an adequate reduction of the price or a resolution of the contract. The seller is responsible if the lack of conformity arises within two years from product delivery date. Warranty of the consumer provided by art. 130 of the Legislative Decree 206/2005 is revoked if he does not inform the seller of the lack of conformity within two months from the discovery of said defect. Unless proven otherwise, it is assumed that any lack of conformity manifesting within six months from the delivery of the product was already present at such date, unless this presumption is incompatible with the nature of the product itself or with the nature of the lack of conformity. Any direct action that points out any defect not willfully neglected by the seller expires in any case within 26 months from the delivery date of the product; the consumer can however always enforce his rights pursuant to art. 130, comma 2 for the execution of the contract, provided that the lack of conformity had been indicated within two months from its discovery and before the aforementioned expiration date.
  11. Intellectual property rights
    The contents of www.maidamila.com, such as for instance works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, logos and any other material, in any format, posted on www.maidamila.com, including menus, web pages, graphics, colors, schemes, instruments, website fonts and designs, diagrams, layouts, methods, processes, functions and software that are part of www.maidamila.com, are protected by copyright and any other intellectual property rights of maidamila and other rights holders. Reproduction of the contents of www.maidamila.com, in whole or in part, is prohibited without written permission.
  12. Applicable laws and Disputes resolution
    These Terms of sale are disciplined by the Italian Law and are construed in accordance with it. Should any dispute arise with the consumer, the competent court will be that of the consumer. The competent court for any dispute with professional purchasers will be maidamila’s.
    The consumer may undertake any out-of-court dispute resolution attempt with entirely online procedures and via the intervention of an alternative dispute resolution organism.
